LEASE DEED
LEASE DEED is made and entered into
on this day ,18th August 2008 .BY AND BETWEEN DR. X
son of XX residing at XXX,ONGC APARTMENTS ,NO-TT, JUSTICE RATHANAVEL PANDIAN ROAD,MOGAPPAIR
EAST , CHENNAI-107., as the owner of building ,NO-##,EGMORE HIGH ROAD
,EGMORE,CHENNAI-08.,herein after referred to as THE FIRST PARTY (which term
shall mean to include , wherever the context so requires ,his heirs, legal
representatives , successors-in-interests,executors,administrator,nominee,assign,etc)
on THE ONE PARTY.
AND
MR Y Proprietor
of DJ
SERVICES RESIDING AT, EE- SHANTI APARTMENTS, Gandhi road gill agar ,
choolaimedu, Chennai 600094, Hereafter referred to as THE SECOND PARTY (which
term shall mean to include , whenever the context so requires , their heirs,
legal representatives, successors-in-interest ,executors, administrators , nominee,
assign etc) of the OTHER PARTY witnessed as follows:
WHEREAS the first party herein is lawful possession and
enjoyment of the property bearing NO-EE,EGMORE HIGH ROAD ,EGMORE ,CHENNAI-08.
WHEREAS the second
party herein referred to as tenant is in possession of the first floor of the
above said property , agreed to take on lease for his business , the above said
area on the terms and condition set forth below:
NOW IT IS AGREED DECLARED AND RECORDED BY AND BETWEEN
PARTIS HEREBY AS FOLLOWS:
PERIOD OF AGREEMENT:
This agreement has commenced for a period of 11 months from
18/08/2008 and shall be made in force till 17/07/2009 prior beyond ELEVEN
MONTHS shall be subject to the consent of both the parties on the manually
agreed terms & conditions shall reduced to in writhing within 3 months
period prior to expiry of this agreement.
LEASE RENT:
The 1st party & 2nd Party agree and
fix the lease rent shall be at Rs. 15,000/-(Rupees Fifty Thousand Only) per
month and further agree that the 2nd party shall pay the rent to the
1st party, or before 5th day of subsequent month for
which it is due and the first party shall issue duly stamped receipt in the
statutory form to the 2nd party.
SECURITY DEPOSIT:
Rs. 1, 50,000 (Rupees one lakh Fifty Thousand Only) has
been paid by the 2nd party to the first party by way of interest
free security deposit. Such security deposit shall be fully refundable by the 1st
party n the expiry or sooner determined by the agreement & or any extension
thereof.
TERMS & CONDITION:
- The rent shall be paid till the last month of occupation and in on occasion the advance shall be adjusted towards the rent.
- The building shall be handed over to the owner in the good condition, as if it is entrusted to the tenant, at the time of vacating the building.
- The owner shall obtain ELECTRIC connection for the building now let out and the initial deposit and connected expenses shall be paid by him. But the additional deposits and charges that may be claimed by the Electricity Dept. shall be paid by the tenant as and when the claim is made, and the same is not reimbursable from the first party.
TAXES:
The first party shall bear and pay all present and future taxes for the
property, local or municipal taxes , levies, rates assessments, dues , duties ,
cess charges and other impositions that including any increase , if any, made
therein from time to time.
THE
SECOND PARTY CONVENMANTS:
Electricity & Water charges- The
2nd party shall pay electricity charges as per reading registered in
the separate electric meter installed in the scheduled property for the sole
use of the 2nd party. The water charges will also be borne by the 2nd
party to the extent of their share of corporation water tax..
USE OF
THE SCHEDULE PROPERTY:
The 2nd party shall use the schedule property as office for
administrative work, or for any other purpose in connection with the business
of the 2nd party.
The 2nd party should not carry on any offensive trade or
unlawful business in the schedule property and also not keep any contraband or
explosive materials or materials in and near the said property.
The 2nd party shall pay charges such as sales tax, commercial
taxes, levies etc, if any in relation to the business to be carried on by 2nd
party in the said property without making the 1st party liable or
inconvenienced on that account.
The 1st & 2nd
parties have agreed that in case the 2nd party commits default in
the manner of carrying our the commitment under the lease deed , the 1st
party shall have the right to determine he lease agreed under this deed.
The 2nd party can terminate the lease by giving written
notice of 3 month to the 1st party within the duration of this lease
or any extended period thereof.
SIGN BOARDS:
The 2nd
party shall be entitled to install signboard on or about the schedule property
at places/points specified by the 2nd party with the approval of the
1st party.
TRANSFER/SUBLET:
The 2nd
party shall not transfer, assign, sublet, underlet or part possession of or
grant any right license in respect of the schedule property or portion thereof
to any person or par, without the expressed consent in writing of the 1st
party.
UNKEEP AND MAINTENANCE:
The 2nd
party shall keep the interior of the said property in good and rentable
condition, ordinary wear and tear expected. The 2nd party shall not
be responsible for any damage caused by accident ,tempest,storm,hurricane fire,
earthquake,riots,strikes,civil commotion war damage caused by vagabonds by
vandals,hooligans,outsiders,enemies of the state, Act of God, or any other acts
beyond the control, of the 2nd party.
INSPECTION OF PREMISES:
The 2nd
party shall permit the first party or his authorized agents and workmen to
enter, the said property to view and inspect the said property during
reasonable business hours only.
STRUCTURAL
ADDITIONS/ALTERNATIONS:
The 2nd
party shall not make any structural alternation or addition to the said
property or any portion thereof the 1st party previous consent. The
consent shall not be unreasonably withheld. in case of erection of such portion
and/or any other temporary or semi permanent structures, fitting and fixtures
as shall be required for the conduct of the partys business . In case any
additions are being made to the schedule property by the 2nd party,
the 2nd party shall be at liberty to remove the same on or before
the expiry of the said period or period of renewal thereof, provided that any
damage that may be caused by removal would be made good by the 2nd
party.
FIRST PARTYS COVENENTS:
Maintenance
of the schedule property – 1st party agrees to carry out repairs for
the roofs, walls, etc, so as to keep the schedule property in good,
tentable.wind or water tight condition. The 1st party hereby agrees
to indemnify the 2nd party in the event of any loss the 1st
party may be put, on account of any loss on the part of the 2nd
party with regard to the terms of the lease. The 1st party guarantees
the 2nd party peaceful of the schedule property without any
disturbance, or interference either from the 1st party or anyone
claiming under him.
ENTRANCE PERMISSION:
The 1st
party shall allow the 2nd party employees, customers, and agents,
invites free and unfettered access to the schedule property. The original
leases deed will be with 1st party and the copy shall be given to
the 2nd party.
ESCALATION CLAUSE:
The lease
fee will be escalated @ 10 % at the time of renewal of the agreement with the
mutual consent of the parties.
IN WITNESS WHEREOF THE PARTIES here to have here under set
AND SUBSCIBED THEIR RESPECTIVE HANDS ON THE DAY AND YEAR 1ST HEREIN
ABOVE WRITTEN.
